Why can't this be challenged in court?

Funny how employees with 15, 20, or 25 years never had discipline issues until now.

Everyone somehow was wrong for doing their job even though they never had problems previously.

Exactly!!! You can't tell me any judge would look at somebody's exemplary record for 25 years and believe they "suddenly" developed issues - be it discipline or any other kind. So why aren't people challenging this in court? What am I missing?

If the behavior causing disciplinary action can be shown to have occurred, then your history is irrelevent. If its he said she said, then you can bring history to prove a pattern of behavior and this is likely false. But if its documented and proven, no court will give you a pass for screwing up in the present
