Severance and Unemployment

I don't know how severance packages work and this is the first ime I have been laid off from a job. If I except a severace package am I still able to apply for unemployment? Nobody seems to be able to answer this question, or they don't want to.

Somewhat surprisingly, this issue is treated differently, state by state. In some states, severance payments from an employer block unemployment insurance benefits. But, in Illinois, severance is considered to be payments to an employee for past services. Under the Illinois Unemployment Insurance Act, severance payments are not considered wages by the Illinois Department of Employment Security (IDES) and therefore these severance payments do not render the individual ineligible to receive unemployment insurance benefits.

Run to the unemployment office today!!! They will help you sort through it unlike HR. You deserve to be compensated somehow. Will buy you time to look for a decent job.

My experience with Follett was severance was paid out as regular pay not a lump sum. You could not apply for unemployment insurance until after the last check. May vary by state. Sorry to say that sick feeling in your stomach takes a while to go away. So many greedy bad decisions hurt so many people. I'd like to think the senior management and family would have a tough time living with themselves but I know they look in the mirror and think how clever they are. Yes, you can file for unemployment even if you received a severance package. I am speaking from experience. Severance is not regular wages.
ASAP file for unemployment, there is a gap of one week between eligibility and your last day on job.

Severance package is 8 weeks of pay based on time at the job. Do you know if this is paid in one lump sum or biweekly like a regular paycheck? Boss doesn't seem to know anything. Drops a bomb but can't answer any questions.

No, you cannot collect unemployment until after the severance money is depleted by way of calculation. How many weeks of pay is it? After those weeks are done, then you may apply. I experienced the same for the first time in 2018. Good luck to you!

Yes you can collect unemployment in addition to receiving your severance.
