It seems that HP must give employees 60 days notice under the Warn Notice or pay them for 60 days in lieu of. Please comment if you have information to the contrary.

The WARN Act requires written notice to employees prior to layoff.
Some companies give 90 days notice plus severance pay. Depends on the company. If the layoff takes place prior to the 60 days being up, then severance pay for the remaining time is mandatory. Severance pay does not affect unemployment.
States also have their own Warn requirements. But affected employees must be given written notice.

I believe that all they have to do is announce that there will be a layoff and give notice, not tell you directly that you are being laid off. So if HP tell you that they are doing a layoff and 60 days later you get laid off, well tough. Most larger companies will offer severance in return for a promise not to bring legal action.
