  • Adope has an unwritten objective to always rotate out anyone over the age of 45 on a regular rotation.

  • Adobe deliberately does not have a published "process" for managing employees performance. Thus, a manager can simply declare 'sorry. You have not performed and your last day is xx"" with no warning or no opportunity to improve. In fact, it's intentional so managers can manage out anyone, on a whim at any time and claim "performance" with zero documentation or process.

DID YOU KNOW?
Adobe had a mass layoff, that is well documented in the press, on Dec 6th. They claim over 100 people in the sales group we part of a "reduction in force" or a RIF. HOWEVER, there were dozens of additional people impacted. Yet they were of an advanced age. So Adobe didnt want them reported within the official layoff filing as it would become EVIDENT that they targeted people 50+. So instead of including these individuals, they suddebly "claimed" it was due to "performance issues".
YES! ✅ ! That is precisely why they don't have a formal performance improvement process or a POLICY that managers must follow. They actually claim "We give managers the freedom to manage their employees without any policy".

And there you have it. Where is @TheJusticeDept with such EXTREME Age 🎯, by proxy of Adobe Policy to NOT have a policy?

Sounds like to preemptively *skirt around the #WARNAct * #WARN simply by how they structure the sales organization.

  • Deliberately creating unattainable sales targets across the board, so they than can just pick and choose who goes no matter the real performance
  • Hiding behind that regular rotation performance firing cycle to never have to report proper Age profiles via #WARN #WARN Act filings

The inflation of sales quotas is WORKPLACE HARASSMENT and BULLYING, especially when it is widespread that people don't meet their quotas.

IF YOU ARE A REP who may have missed your quota and got the quick termination (because Adobe doesn't even do the "Manage People Out' process, they have no process) AND others on your team missed their quotas BY MORE than you did, YOU WERE TARGETED out of the organization unfairly. They may not have a policy to manage the process, but they are held accountable in a court of law to treat employees equitably.

They inflate sales targets to attempt to "legally" get away with this scheme. Adobe should be careful. You can't set unattainable sales targets simply so you have the ability to rotate out employees whenever you feel like it without consequence. I believe there is Case Law on this, was it IBM who is currently working out a settlement with the Justice Department for doing just this?

Umm, yes. This is well known. They claim the Adobe Way makes them the best employer. The problem is they have an objective to keep average age to about 35-38 yrs. So they focus on 'being cool' to keep the 20 something's coming in, yet they need the 40 something's to actually get the job done. And then the 30 something's actually believe they are God's b/c they don't realize that in Adop-ee land they are really 50 something. So they are used to carry out the mis-deeds, yet totally go along with it as they are too green to understand what is really going on, and that they are really not supremely awesome (they are just being used to get rid of the 45+).

I witnessed this on my team. A muslim over a certain age and a women over a certain age. both informed no more job due to performance, with zero further information. Still shaking my head at the blatant discrimination. Also pretty shocked that our entire team just goes along and pretends it is normal. In fact the manager is now actively hiring. How is that legally possible?
