Hi I am currently in a situation with CDK Global as a current employee. I have a massive amount of evidence and I'd like to talk with a fellow sufferer.
What's the wage claim for?
I get paid every two week. Because CDK charges every time they process payroll.
It cost my employer less per month to pay biweekly.
CDK does not keep up with clocked hours for my employer. So overtime hours for Car Dealerships are not paid. Most all Dealership employees work 12 hours a day 6 days a week.
I was fired while waiting for disability access accommodation at an old facility that wasn’t up to code for the ADA. EEOC assisted to a point, but I had already found employment elsewhere. HR was very aggressive.
The above mention law firm doesnt feel this is a strong enough case against CDK and has decided not move forward. However, two other frims have gotten word about CDK and are researching there poistions to see if a class action case against CDK is possible. More to come.
I have submitted my grievances regarding CDK working conditions and their culture of allowing and participating in workplace bullying by National and Enterprise clients to The Hersh Law Firm in Dallas, Texas. Let's see what happens.
How they can force their Field Service Engineers to be on 24/7 on call rotation and only compensated with 2 hours overtime is beyond me.
The Hersh Law Firm in Dallas, Texas is interested in learning more about your situation. If you feel CDK has violated any labor laws involving you or fellow associates contact their offices in Dallas, Texas.
I believe all of the above is true, except for the age discrimination. We have a very large force of older, mature people. In this industry, you need to have experience doing the job. Some younger people without experience ''CAN" quickly learn, but without the dealership experience, it's very difficult to learn the business. That said, I know the company wants to 'appear' younger to attract a buyer, who may not understand the business. I also know there were many younger people hired, in an attempt to bring our average age down, under the guise of needed college graduates with degrees which will help the company in the future. Most of those people left.
We are forced to input that we work 8 hours a day in our time card, regardless of if you work 16 or 18 or more. Coerced to work weekends. We usually get paid, but it's a paltry Doeknow some of the contracting companies collect the weekend pay money and don't provide it to the contracted employees for working weekends. I know that someone had complained to HR about our low bonuses and they were written up for complaining.
I worked for CDK as a French tech support rep for Drive for 3 years, at first full time and then part time. When I told my boss that I was going to leave (and gave 3 weeks notice before doing so) I was asked to work my last week full time. I agreed under the pretense (which had been posed by my boss, in fact) that I would have some extra money before leaving. Upon receiving my final pay, I noticed that the check was about 800 dollars less than what I should have received. I contacted my boss and the HR department trying to get this sorted but was given an abrupt 'Your final pay is correct' from both. If anyone has had similar issues and some sort of large scale legal action is taken against CDK, please notify me.
Regarding age discrimination, the reason so many of those recent interns and new hires were let go was to offset the ages of tenured associates to prevent such a lawsuit from gaining traction. So for those I've seen post "Why did CDK offer me a job in the first place if they were just going to turn around and lay me off a few weeks/months later" that is your answer. You were a pawn in their numbers game. Associate bonuses probably went to pay for the short-term salary and benefits of the sacrificial lambs who were brought in just for the slaughter.
I hope something happens. I see all the time people not compensated for overtime.
