If your manager tries to force you to choose hybrid, tell them you're staying remote. Make them fire you.

It depends on how pro employee or pro employer the State is. But you don't want to be in a position to fight for your benefits.

1: if fired you will have to fight for and prove you deserve unemployment
2: laid off you get unemployment

The footwork is on you for #1. You may win but it will be you needing to mount the offensive.

Texas unemployment eligibility:

If you were terminated from your job completely, you can collect benefits. This includes a demand for your resignation. However, if you violated company policy, broke the law, neglected your duties, mismanaged your position, or failed to perform your work duties despite your capability of doing so, you may be denied benefits.

@ Remote You don't know wtf you are talking about. I've been fired and laidoff and on both occasions in Washington State I got unemployment. As someone also stated you only don't get it for GROSS misconduct - ie theft, as--ult or S-x Harrassment etc

That’s incorrect. “Cause” can be as simple as breaking policy. The company only has to prove that the policy is documented and expectations were communicated to the employee that broke them. That alone is enough to ensure one doesn’t get unemployment.

Do you not understand what’s going on here? The company is taking these steps to SAVE MONEY on severance and unemployment. If it was a simple headcount reduction they’d do a few big layoffs and be done with it.

The RTO (without any means to prepare the office spaces or effort to preserve productivity) is to force attrition without paying for it. And it’ll work, to some degree. You’ll see a big chunk leave after bonus payout like every year. But because the job market isn’t great, many will be forced to stick it out. And the company will keep squeezing until more and more leave on their own. Many WILL get fired for cause, regardless of performance.

You should prepare yourself. And you should talk to an employment lawyer about unemployment before giving people a false sense of security. Many will not get the safety net of unemployment.

Bottom line is don't let them box you into policies you cannot adhere to. Else they may use your lack of cooperation to those policies as ground for termination. By accepting hybrid you're basically moving within the walls of the city and will have to follow their rules.

By staying remote they will have to adhere to the laws of your city/state and the physics of you being outside of the their walls.

Whoever said you only get unemployment if you’re not fired is using a well-worn chestnut that is false.

Most state governments will award you unemployment no matter what. “Cause” has to be obvious gross misconduct such as physical as--ult or theft.

“Performance” is not usually accepted and “he refused to relocate to another state with no relocation allowance after we changed his terms of employment” is going to be viewed as constructive dismissal.

You’ll get your unemployment.

Clarification: You get unemployment if you get laid off, NOT if they fire you.

Choosing remote might get you laid off, but failing to adhere to the guidelines of hybrid (which will no doubt become increasingly rigid) will give them leverage to terminate with cause.

Make no mistake, this policy is about reducing the workforce and not having to pay severance to everyone. If you think hybrid is the safe option, think again.

The leadership in my org is encouraging us to choose remote and many of us are. There’s strength in numbers, so don’t be afraid to make that choice if it’s better for you.

The company is going to be making huge cuts at will and people are going be let go regardless of hybrid/remote status. Take care of your well being now and try not to get too crazy over all this. They are not worth your heartache.

Yes. They are actively trying to force hybrid. Your manager is the last line of defense for strong-arming hybrid.
They already know remote selection is going to be overwhelming do they are trying to stack the deck.

I was reading the whole thing again today and I noticed that it says you can “request” remote (although hybrid is strongly encouraged) and then once the “exercise” is over, HR will “review” it wnd let you know. My manager said he approves it but something tells me the manager doesn’t make the final decision… HR and facilities does.
