Molina Healthcare Inc. may have interfered with a diabetic employee’s right to take protected leave when it formally disciplined and then fired him, the Southern District of Ohio ruled.

The same evidence could also convince a jury that Molina retaliated against end user support specialist Richard Redick in violation of the Family and Medical Leave Act, the court said Jan. 6.

Molina approved Redick’s use of intermittent FMLA leave to deal with complications of and seek treatment for his type 2 diabetes. But he says his manager immediately suggested he might abuse the leave and that he later faced illegal...
