@12qhXe51-1lmf, are you sure about this? Which states? Couldn’t find anything online about that.

The severance package is clearly explained in HR Direct, and is based on your grade level and collective years of service. With the exception.of California and possibly a few other states, your accrued PTO over 40 hours (or any at all) may not be paid out to you as paying out earned PTO is not required in other states. Typically we see individuals who plan to resign take two-weeks or more of their earned PTO in a single chunk to get their PTO hours below 40, then return to the office and quit. This ensures that were able to use their earned PTO.

Different business segments (acquired entities) may have their own requirements for severance packages which may have been carried over from their previous employer.

When an employee quits or is fired or laid off, all accrued, unused vacation time must be included in the employee's final paycheck. According to California law, PTO and vacation are wages that have been earned by, but not yet paid to, the employee. Once you earn vacation or PTO, it cannot be taken away.

Not paying severance is a crime in many states. PA requires 24 hrs non bailable jail for the accountable officer in case salary, bonus, severances are not paid. Something is missing in the above story. Hope, no one needs this route.

The Optum 360 severance is right. Check your state for how much PTO they HAVE to pay you. They will try to do just 40 hrs but some states require they pay out your fullPTO owed

On the hub if you search severance you can find the UHC document. In the recent layoffs, those persons were not all given the severance as posted (according to them)

Doesn't matter whats posted in the policy or what they say publicly. I don't think they follow their policies. I got no severance and I had good performance reviews and never given performance warnings. They said its at their discretion. Good luck.

I noticed that too...there's a UHG Severance Pay policy and an Optum 360 policy. I swear there used to be an OptumHealth policy posted as well because I checked it when a colleague was laid off last year but it has mysteriously disappeared.
