Thread regarding IBM layoffs

Can laid-off US Employees collect Cares Act $600 unemployment supplement or is IBM denying this is COVID related?

I chatted with an HR representative online (only practical way to reach them) and asked "Can laid-off US Employees collect Cares Act $600 unemployment supplement or is IBM denying this is COVID related? Florida pays only MAX $225 /week but federal Cares Act would provide supplement of up to $600 and additional time to collect, provided layoff is COVID-related. HR says "contact your specific state" and IBM won't confirm that the layoff is due to COVID in any way, but also... "they don't have any documentation to deny it." Cheeky b–tards. I am going to contact FL before signing the separation agreement to see what documentation they WILL require after my 30 days of run-off,

Not all California employees received 60 day notices. I'm in California and received a 30 day notice.

Note that in California, the governor suspended the 60 day WARN notice requirement for layoffs, if (among other conditions) that layoff was caused by coronavirus. IBM did not send out 60 days notice, so this must mean either (1) they are under the number-of-people-affected threshold that the normal WARN act required or (2) they are implying (even without announcing anything) that the layoff was coronavirus-related.

That may not be true .. it depends on the wording of the agreement - is it actually severance, or is it a payment for signing away your rights. If it is not severance, you can file on June 22.

It also may vary state-by-state.

If you are let go, you cannot collect unemployment until AFTER the severance period. So, if the last day is June 20th and you receive 1 month severance, you cannot claim unemployment until July 20th. By then, the Covid money is gone.

Call your Congressman and lobby to extend the $600 of additional unemployment in the upcoming relief package, as it expires on 7/31.
