Keep in mind Nj/Ny have a warn act. There was no warning of your departure there for by law they have to pay you severance.

You lose the money. Remember a organization does not have to pay a severance. For Macy*s the next time around, there wont be any money left to pay a severance to the next group of people. Stop with all the class action suits and that nonsense. M is a struggling company and this is what happens to a company in the situation they are in. Hell even in places that are profitable positions are still removed, lost or restructured and folks get a severance or another job offer.

Actually, an executive laid off last year did not sign the severance and went to an attorney. He won, got a years pay versus six months and Macy's had to pay the legal fees. I just heard on the news that laid off Boeing workers are getting 2 years unemployment,...……..AND if the job they get is lower paying they get the difference for 2 years!!!! I say what!

Severance is a nicety. It doesn’t have to be offered at all. Enough people will sign preventing a class action lawsuit which is the only way it would make sense for a law firm to take up unless you want to fund it yourself. Know their lawyers have already covered their butts. IF you have evidence of wrong doing then you could go to a lawyer and they might be able to get you a larger payout but unlikely. Take

And what happens if you don't get a severance? Just because they have powerful lawyers they shouldn't treat people like crazy and more importantly colleagues shouldn't be afraid of their so call power. Power belongs to God period.

Ditto what the other two said: you don't sign, you don't get your severance.

BUT

If you sign (at least the contract I had to sign) you forfeit you right to sue. Corporations have great lawyers, so suing is extremely risky, with little chance of a payout, high legal expenses, and you'd still lose your severance, but it is an option if you think you have a case for a lawsuit regarding your termination.
