WARN Act

Does anyone know if Honeywell is in violation of the WARN Act. I'm not a lawyer, but it seems that they we should have received a 60 Day notice not a 20 minute notice. Is this a class action suit??

You think it was a coincidence we had 2 RIFS roughly 4-6 weeks apart? No. They did that to avoid any WARN notices. They knew from the beginning they'd be doing it again and exactly who would be going each time.

Department of Labor Warn Act info (read the part about voluntary retirements)
https:// webapps.dol.gov/elaws/eta/warn/i2.asp (remove spaces for link)

They asked for volunteers, then accepted them (with not allowing anyone to change their minds). This allowed them to then maximize the reductions without reaching numbers that trigger WARN. Then it was just a matter of picking the demographics to make sure they wouldn't get sued. This isn't their first rodeo.

WARN act also has language in it that the pandemic could remove the notice requirement. Something about times of great distress or something like that. I don’t remember the exact wording.

The warn act requires them to notify when a certain percentage of employees at a specific location are terminated. With so many sites it’s hard to reach that threshold at any one given site.

Each state has their own WARN ACT

Usually for large companies they need to lay-off a large quantity of people like 250 or more

In my state the limit is 250 and they laid off 220 per my severance agreement. Surprise it was under the limit
