Has anyone challenged the severance package with a lawyer yet?

You won’t win. They laid off alot of older people but to cover their own tracks they laid off younger people as well. If you read the document you can see who was offered a package by age in you’re store. If they are still there they took a new position with a pay cut. I know for sure op/lp manager was offer a package but took the new position instead. (Bad move) company sales are in the toilet

I was the ONLY associate at my store who declined the initial offer from Macys when my store was closed in 2017. I did not have to get an attorney at all. It did take several weeks of email and phone negotiations with their HR person to get the amt to accurately reflect the # of years I worked for them. No one else wanted to fight it, saying they were disgusted but just wsnted to be done with it. They signed, got their $$ a couple wks later, and went their way. I had to wait about 4-5 wks longer, but I proved tp them w/my online check stubs that their math was wrong & I was due considerably more than the initial amt. When I presented them with the evidence from their own Insite records, they reviewed it and agreed that I was right. They paid me what I asked since they hadn't computed it accurately. IF it's a matter of addition/subtraction, you can get the offer corrected. But if you just think you should get more because you're more "worthy".....well, good luck with that, honey.

I would imagine there may be one in a thousand that would challenge a severance package.

There are two problems with this route.

  1. Cost - the cost of the lawyer will certainly outweigh any increase that MAY be acquired through a lawyer. So the current severance package is standard operating procedure even thought it is not required. What would a lawyer gain above and beyond the current package if anything? Not much. Therefore no lawyer will waste their time to gain a small amount of money. No big payout = no interest.
  1. Macy's is not required to provide severance. Presenting a case to increase the severance dollars would be near impossible.

I gave it serious thought but ultimately decided against it.Age discrimination was certainly not the issue but gender bias was evident.Many colleagues let go had greater numbers in productivity and years of service .
Let everyone I was an employee at will and Macy’s was not legally obligated to offer severance.Restructuring and eliminating ones job description is a sufficient reason.
