Thread regarding Dell Inc. layoffs

What is really sad is a couple of years ago, Dell updated their employment contracts and coerced all legacy employees to sign new employment terms which contain non-compete provisions for 12 months.

So you get laid off, you get some severance, but if you want to go work at a another PC, Server, Networking, Leasing, IT Services, Security services, virtualization software company....Dell will object.

When you apply to new employer they will ask for your employment agreement and when they see the non-compete language they will ask you to have Dell agree to waive non-compete provisions and Dell refuses to do that (even if they lay you off).

They prefer you remain unemployed for a full year vs work for a company they might compete with. Dell has so many businesses they compete with almost everyone in the IT industry. There should be legislation that voids non-compete language in employment agreements if you get laid off through no fault of your own.

That's illegal in some countries. I suggest people get legal advice on this particular issue.

And no company, especially a large one, is going to even notice when an average worker bee goes to work for someone else, especially after they've been laid off. In fact, when I leave a company I never tell them where I am going. None of their business. Most of these NDAs are unenforceable anyways - they count on employees being scared of the language. The ones that are typically really enforceable are the ones the executives sign.

In a layoff the non compete is completely un-enforceable. So says my attorney wife. "that is unduly adverse to employee's, to expect a company can terminate them and still expect them to uphold the freely signed contract of the company employee agreement"

In lay-off you most certainly must adhere to non-compete. My bet is the package is slightly better than anticipated so Dell can show they gave you something of value in exchange for non-compete.

It’s not only lawyers but it’s half the population that decides to vote on smaller/weaker govt and at the same time allow corporations to expand by giving them more tax cuts. A lot of these companies have budgets higher than some countries. So while the Right is anti big govt, they r enabler of such micro-states (corporations) that can do pretty much whatever the hell they want. It’s all about awareness, education, and compassion.

Dell’s interest is in protecting their IP and roadmaps, not in preventing someone from regaining employment. At least that’s what they were socializing in July.

Sorry, in a layoff scenario thats not defensible. If you get laid off after you serve out your notice/garden leave period you can go work wherever you want.

Lawyers and MBA's have ruined every faucet of life. There are no more certainty in anything regardless of the career nor education one chooses. Many weren't aware, and didn't think the effects.
