What is the purpose in this verbiage? Definitely looks like a lay-off to me.

Suspect a XOM lawyer inserted this provision in the Severance Agreement to protect against an age discrimination claim for those hired afterwards. Typically, by signing the agreement without this clause, you waive any claims of age discrimination PRIOR to the date of signing the agreement. If you were to come back and work for the company again, you would be entitled to file an age related claim (or other protected class claim) for the period AFTER the effective date of the agreement. The insertion of this clause protects the company from both periods of claims, the latter being unlikely if you never reapply and get hired for employment. The clause however does not preclude the company from asking you to work for them although I assume that would be on a very selective basis and the current economic climate has reversed.
Is the new ranking quarterly?
The tiers of management per team are absurd. Do you really need five levels of managers for a team that barely has work? What are they doing outside of sitting around collecting their pay? So we cut a lot of the worker bees that actually do work for half the pay. LOL poor strategy
I don’t see where a lot of the people cut were low performers. In fact I KNOW a few people cut were not low performers. It appears the people cut were on projects halted, teams that were too large for the work, had some sort of disability or possibly at some point asked too many questions.
@1hrb - I would want to come back not for the salary but just to keep the opportunities open, never smart to burn bridges. Thus I think it's smarter to leave by June before everything is "finalized" and set in stone. Esp for those that have had projects cut and time is just ticking away till the next cycle.

Well, if you leave voluntarily and want to try and come back later, it won’t be because of the salary. So don’t waste your time. The next round of “layoffs” are going to make heads spin or mouths drop...or both! Oh, and don’t think dividend payouts are going to be saved. Those Executives and Managers that are saved this time are going to do everything possible to make themselves shine not sparing anyone! Start calling those financial planners, you’re going to need them.....very soon.
@ 1rzd - So are you suggesting accepting the PIP or just putting a standard 2 weeks in after you find out rank? Because the chances of them hiring you back if you are ranked badly on your last year I assume is low. But if you were ranked okay previous years then you might have a case.
That’s the whole reason why large companies offer severances and payouts in the first place.
They aren’t being nice by giving you the three month payout, and aren’t doing it out of the graciousness of their heart. They are covering their butts legally by incentivizing you to sign the paperwork.
Why would you quit before you knew? Just quit when you find out and don’t sign the paperwork. Sure you won’t get the three month payout but you will be able to attempt to come back by not signing a document saying you are unable too. Texas is a right to work state and that can benefit you as well. Don’t sign anything and quit willingly. Why do you think they choose to give a 3 month payout? For you to sign the document saying you won’t sue them and won’t come back to work for them.
If you think you’ll be ranked low is it better to just quit around June so that you at least can come back to the company at some point?
Highly doubt any of the good people screwed in this lay-off would go back to such an incompetent mess
Why hire back a low performer? When you see a resume stating worked at XOM till July 2020, you assume bottom performer. Reject. Next application.
