most of my plans had a cap if a single deal was over 200% of plan, but not if the quarter went over 200%... always on an individual quota plan when I worked there. They screwed me on commissions in other ways, but the cap was not one of them. They also have a clause that basically lets them alter your plan/quota/payout at will at anytime.

anyone who has worked near the large commission structures know this:
a) they do get capped sometimes
b) they dont get capped sometimes
so yes a) and b) seem very arbitrary and capricious.. and open to litigation IMHO
c) you can protest a cap (and win/settle) but dont expect to keep the job (and would you even want to)
d) IBM discriminates (age, s-x, race) except maybe gender cause they seem to be able to generate good PR around that.. they can deny systemic discrimination like the Royals' "Firm", and will of course

so I've witnessed "illegal" capping for 40 years
