Last nail in NJ EMRE box? Court decision disallows Contractors v. Union folk

From Bloomberg Law of 8/27/21 (only text available before the pay wall):

An Exxon Mobil Corp. research subsidiary can’t permanently contract out union positions at a facility in New Jersey thanks to an arbitrator’s decision upheld by the Third Circuit.

The Philadelphia-based appeals court Thursday rejected ExxonMobil Research & Engineering Co.'s argument that an arbitrator improperly went beyond the essence of the collective bargaining agreement by considering company statements and prior arbitration decisions.

“We cannot agree with this rather myopic view of the limits of the CBA and the restrictions it places on this or any future arbitrator,” said the three-judge panel of the U.S. Court of Appeals for the Third Circuit."

Next to Bezos, ExxonMobil is the MOST anti-union corporate socialist on planet Earth.

Moving the entire Clinton site to Texas might cost 5 Billion.
They would certainly do it. If only out of spite.

@2YMY ...they won the appeal dummy, that’s major. I agree the strike was lame, but management here is the most arrogant I have seen in my career.Totally mismanaged the whole COVID event working from home on zoom “really “ and we are essential personal being exposed,way behind the curve. Get the buses ready to take 102 , 475 off site. With safety boy driving,Management doesn’t understand the meaning of “Temporary “ some on site over 10 years. Going to be fun to watch, like the Ta----n they only understand force. Get these high paid rats off site...pay your dues day of reckoning coming. Enjoy your time off, unfortunately all this is most likely to late....could be the last nail.

@2spr+1cB0qDjj. ILEU is just as useless as Exxon management. We can't even strike properly. One or two day strike and union leaders think we stick it to exxon. Several years and no contract

ILEU sure did great on protecting IT, admin, and trades getting outsource. Bunch of research techs thinking they got it rough.

Put Ricky in charge for a year he’ll do a better job, soon he’ll be at $15.00 an hour, 4 years no raise ILEU, @2jjg, you must reside on the third floor. Proposed to outsource any union covered position, it’s over now ...get a grip, Your head of HR is useless also.

@blue collar witness. i think your animosity towards YL is misdirected. i doubt she has any power or authority to influence negotiations. she’s not perfect, and has received some well-deserved criticism on this board, e.g., being too focused on overburdensome EM process….but i doubt she’s anti-union, probably because this won’t be her problem in a couple years. what may happen is the adverse stance the union has taken against the company will backfire and they will decide the site is no longer worth the cost and shut it down and there won’t be any jobs for anybody, union trades or research techs

About time! Choke this down YL. Way to many contractors on this site working Exxon jobs some as long as 10 years. Some rats for Department Heads. ( PPLE) get these contractors out of planner and supervisor roles, up-rate your own employees! Clear out 102-475 and your safety boy, end the abuse.Someone should audit the books on pay rates, Temporary was way abused. Don’t believe their lies...

Apparently the Clinton basement flooded the day after the Appeals Court ruling.
Essential plant equipment and support organizations (Shipping/Receiving/EMIT/etc.) were underwater. I think the site remains closed as of Sept. 1.

All contractors on site today are probably temporary.

It is likely the negotiated collective bargaining agreement was designed just for this purpose and to provide another solid nail for closure.

Tax-breaks can't be clawed back or forward generally - even in sensible NJ.

The site is poorly located, poorly maintained and has 20 shutdown Pharma sites within 10 miles. That can also be written off.

It is a Win/Win for dividenders and executives.
