Vaccination Update

Hi everyone,

I know how hard each of you has worked this last year and a half during a global pandemic. And with it has come so many stresses, concerns and changes in protocols that make work – and life – even more challenging. I’m grateful for your continued dedication to our business and our customers, and I am impressed by your resilience.

Your feedback has been critical in guiding our decisions throughout this time. Thank you for your input in our recentCulture Pulse Survey, colleague roundtables, as well as through your People Leader discussions regarding all aspects of our workplace – including vaccines and wellbeing. We respect your diverse views and individual concerns. Know that these topics have been a priority for our leadership team for a long time.

We’ve reached a decision that reflects our continued commitment to a safe workspace, while also positioning us to comply with the news announced by the Biden Administration. As a first step, we will require corporate and MCCS colleagues to be vaccinated or show a negative COVID-19 test before entering the workplace.

As you can imagine, implementing a process like this is big and complicated. And the resources to do so will take time to implement. Our plan is to roll out a vaccination or testing process beginning with corporate and MCCS colleagues that work in our office locations, and then implement and scale a program across the company once we have a better understanding of official guidance and key learnings.Direction for our store and supply chain colleagues will be established and communicated once we understand the official guidance from agencies like the Occupational Safety and Health Administration (OSHA). The full implementation of the program across all colleagues may take several months.

Here’s what to expect next.

More details on our vaccine verification and COVID-19 testing for our corporate and MCCS colleagues will be shared the week of September 27, including resources for People Leaders and FAQs.
Colleagues in our stores and supply chain locations will receive updates as soon as official guidance is made available.
In the meantime, you don’t need to do anything differently. However, we do continue to strongly encourage any colleague not yet vaccinated to do so if they can.

Along with implementing vaccine verifications and testing protocol, our corporate colleagues will continue to operate in a “soft launch” mode and we will not put into effect our return to the office until early 2022. Our office locations will be open and available if you choose to come in. With our safety protocols in place, we encourage colleagues to utilize the space for team-related functions, when appropriate. More details will be shared later this week.

As I’ve said many times before, your health and safety come first. These steps help to further our commitment to providing you with a safe and productive work environment.

Nope it is not against a HIPPA act.

Implications for Public Health
The Privacy Rule strikes a balance between protecting patient information and allowing traditional public health activities to continue. Generally, disclosure of protected health information without the authorization of the individual is permitted for purposes including but not limited to:

disclosures required by law (45 CFR § 164.512(a)) or
for “public health activities and purposes.” This includes disclosure to “a public health authority that is authorized by law to collect or receive such information for the purpose of preventing or controlling disease, injury, or disability, including but not limited to, the reporting of disease, injury, vital events…, and the conduct of public health surveillance,… investigations, and… interventions.” (45 CFR § 164.512(b)(i))
Definition of Public Health Authority
Defined as “an agency or authority of the United States, a State, a territory, a political subdivision of a State or territory, or an Indian tribe, or a person or entity acting under a grant of authority from or contract with such public agency, including the employees or agents of such public agency or its contractors or persons or entities to whom it has granted authority, that is responsible for public health matters as part of its official mandates.” (45 CFR § 164.501)

Macy's won't be able to keep staff if the vaccine is mandated in the stores. Biden's push to mandate it is already raising lawsuits and it won't happen anyway, but if Macy's pushes it, you can figure on at least 1/3 walking out. Add that to all the open jobs and there will be over 50% of those hourly jobs vacant.
