its not just age discrimination any more its also ethnic discrimination

If your name is Raj, Ranjeev, Rahul or some other Indian derived name you are golden

Many folks will now only hire and or promote people from that ethnicity

It isn't illegal to lay off people over 55. To win an age discrimination lawsuit you have to prove age was the reason they were laid off. Not so easy to do. With a surplus, many undeserving employees of all age groups lose their jobs. Also important to note, what is the average age in a surplus group? If the average is on the older site, odds are some older people will be laid off and that isn't illegal.

Stankey will fight this award with all his being, you can count on it. No way he is letting this slide, too much risk of a slippery slope, it this stands, think of all the new lawsuits that will be filed. This would break T, oops T is already broken!

You can still bring about a lawsuit if a law was broken - waiver or no waiver. Depending on the state, Courts may favor the employee. Companies cannot get away with a crime by hiding behind a severance payout agreement.

T openly practices illegal age discrimination. The lawyers probably figured out the number of jury awards would be extremely minuscule, as most people just sign the waiver they will not sue because they need the severance. I have seen the layoff spreadsheets given to those laid off during the last two wackings in my org, and 99% of the people were over 55 in violation of the law.

This person was a higher level and probably not like the 1st and 2nd levels that need the severance to survive. Perhaps when the Stink and HR Blondie Ratbert reduce the severance to two weeks, more 1st and 2nd levels will be enticed to sue as the severance won't be worth $hit.

T will fight any employee law suits for decades, until the plaintiff dies. Only the lawyers will see any $ from any settlement.

Please note that our worthless Gooberment Agency , which has the infinite resources to fight T, never charged with going after Toxic T to get them to change their ways.
