So…which part of that different treatment is rooted in any of the factors in the act you cited or subsequent case law related to said act.

You clearly don’t work in legal, since anyone who works with them knows they’d never give you a definitive answer without talking to outside counsel first. I’m guessing you didn’t go to law school, but maybe a T4, or you have your law degree from YouTube U.
I’m not saying any of it will come to pass or is fair, but don’t cite laws you don’t understand (or worse, are purposefully misconstruing) and spread misinformation. There are literally thousands of examples of large companies legally doing exactly what you say they can’t do right now, and how many successful lawsuits have there been against them?
Actually I have great knowledge on how the laws work..
- CDC admits vaccinated can get and spread COVID
- CDC admitted those that had Covid but are not vaccinated have never transmitted it afterwards to anyone in any records
- The shots are still emergency only...the FDA approved shot will not be available until end of 2022..
- The courts have ruled the emergency shots and the FDA approved are legally distinct from each other and are not interchangeable
- The courts so far have ruled all Federal mandates are unconstitutional
Based on the above if there is any disparate treatment...let's say someone for medical reasons can't get the shots..and if ONLY non vaxxed have to wear masks...you are treating them differently...

If only non vaccinated have to wear mask in the office...then that is separate treatment and exposes people to retaliation possibly by others...

It's a legally risky issue in countless ways, which is one reason why the company has this far treaded very carefully. They are clearly waiting for the courts to decide before doing anything rash.
