Most contractors still pay taxes like an employee. There are no more true contractors at Cenovus. They're all contracted through some staffing agency who takes an hourly cut of the wages and takes CPP and EI off the rest to appease tax authorities. It's a corrupt system that allows corporations like Cenovus to exploit their workers with a veil of legal protection. Obviously they're not the only company doing this, but the assumption that contractors make more than employees due to tax savings is false. Cenovus pays the premium to the contractors employer to essentially act as a payroll provider. Most contractors at Cenovus would be considered employees by any measure, but they signed a contract explicitly stating otherwise. That's Cenovus's only legal defense if any action were to be taken. Companies like Adecco act as pimps that allow for a flexible workforce, and they're only growing. That means fewer people with a legitimate safety net besides EI if they are laid off, and more people bitter about doing the same or more work and not being compensated the same as their peers. Is there a legitimate class action lawsuit here? Cenovus contractors unite? Might help with a payday and avoid the pain of a union. This is the way.
Contract Operator — Do you want a bonus? Take an hourly rate cut and become an employee. In exchange you get benefits, pension and bonuses (and some level of job security). Make a choice.
BTW, this isn’t a Cenovus-thing. The Canada Revenue Agency could rule that a Company providing “bonuses” (which are for retention/loyalty) to contractors is crossing the line into employer-employee. You don’t want this ruling because you haven’t been paying taxes like an employee. Cenovus doesn’t want this ruling because it would be on the hook for back taxes, CPP, EI, penalties and interest. Read the CRA website (IRS is similar).
