They are all unconscionable POS. Obviously they will never be locked up as is deserved. He-l they won't even get fired. But if any other employee ever opened IBM up for litigation, their badge wouldn't even open an envelope the next day. In fact after its proven they broke the law, there should be the opportunity for those discriminated against to file civil suits against individuals. It shouldn't matter that they were employed while breaking laws. They destroyed careers and lives with a few keystrokes. Make the money they earned in the process open to restitution. And no IBMer should ever complete a BCG course again until some of these upper echelon aholes are held accountable

Reading the verdict shows the judge stopped short saying IBM is lying! WOW...!

"...there are serious questions concerning the credibility of this testimony which preclude summary judgment at this time"

And

"Plaintiff notes that this narrative presents significant factual and credibility questions that must be decided by a jury. Plaintiff also notes that there is direct evidence that challenges the credibility of Lemnios’ testimony."

Finally the judge saying:

"...but again, this is an issue whose resolution will turn on credibility findings. In discrimination cases, the absence of any direct evidence requires an assessment of circumstantial evidence, which can be probative. The presence or non-presence of circumstantial evidence is, by its nature, dependent upon resolving issues related to credibility. Based on the foregoing, IBM’s motion to dismiss on summary judgment grounds is denied."

So this should be very interesting if the jury will turn a verdict saying they don't believe IBM and AK testimony... I.e. lying under oath without the severe criminal consequences of doing such!

Hopefully it goes to trial to help all other cases past and future.

The judge's decision to allow the case to move forward does not establish that Krishna actually asked to have Schenfeld fired. Rather it indicates there's enough evidence that a plausible argument can be made at trial to determine whether that actually happened.
