Nike Non-Compete + Medical Insurance

If Nike forces you to sit out on a Non-Compete... do they have to continue to pay your medical insurance during that time? Does anyone have any insight on the medical insurance side?

Nike's non-compete agreement will pay you "consideration" of 50% to 100% of your Nike salary (without withholdings) if invoked. Most of the time it Nike does not invoke it. Because they are paying you, it is enforceable. (Non-compete agreements without compensation are illegal.)

For a few years now Nike does the non-compete agreement as part of the hiring process or a role change. If someone has been around for long enough without a promotion or horizontal transfer, they may not have been asked to sign one.

Most of the time, shortly after separation, Nike Legal sends an email waiving the non-compete.

If you're subject to the agreement, you should have a copy and can read the terms, conditions, and coverage yourself. It's unlikely to include medical coverage, but I'm sure there are special cases.

If you haven't signed one previously, and they are asking for one while you're leaving, it's an entirely negotiable situation. Get advice from a lawyer or a friend who works in HR somewhere else.

This non-compete agreement is where you agree to tell Nike the name of the company you are going to, if known. Otherwise without that clause, or a similar clause in a different agreement, you don't have to say.

If you are in Oregon non-compete is likely not enforceable. If the Swoosh wants you to sign something, you are in the driver's seat and can tell them what you "need" in order to sign.

If you are in California Non Competes are illegal and have been successfully argued against in court.
