Thread regarding Dell Inc. layoffs

Older Workers Benefit Protection Act of 1990 .

Has anyone laid off received below information it’s federal law?

Group termination considerations
If you’re terminating a group of employees who are protected by the OWBPA, and you’re asking them all to sign waivers, you have additional requirements. This applies when you terminate two or more covered employees over age 40. The layoffs don’t have to happen at the same time. These regulations apply if they’re all related to the same decision-making process.

You must give the employees certain information about the other people who are involved. That includes:
Ages of all terminated employees
Job titles of terminated employees
Ages of employees the company keeps
Eligibility factors for the offer
The reasoning behind requiring this information is that it could be relevant to the employee’s decision whether to sign the waiver for an age discrimination claim. A group layoff situation also increases the consideration period from 21 to 45 days.

I received this information. Definitely appeared I was the least of a HR risk out of my peers to layoff, even though j was the highest performing.

I was not given the document before I was required to sign the NDA. It came afterwards.

Way back in the olden days of 2002 I was layed off from a technology company and those of us not in the core of engineering were laid off. They gave us a sheet of paper that listed information, not their names, about each person being laid off, their age, tenure with the company, salary and title. The amazing thing was that all of the managers made the same amount of money and the rest who were at equal levels were paid near the same.

I received a document when WFR'd in Sep 2020. Exhibits with titles (just similar positions) and ages of affected and not affected. I was the oldest (surprise!) All confidential of course as term of separation.
