I'm currently on a short term disability leave due to cancer diagnosis and it will most likely go into a long term disability leave due to multiple surgeries and more chemo/radiation. I read the benefits book but am still not clear if I can be laid off while on either leave or if I have to return to work first. I'm in Oregon so know for sure I will be laid off by 4th quarter. Multiple managers thought I can't be laid off while on these leaves so wondering if anyone has specific experience with this, not just parental leave. I do plan to call HR closer to the end of my STD but wanted to hear from others experience.

Thanks for posting. I couldn't find anything on this myself, but my understanding is the can payoff, but the process begins when the employee returns from leave.

I was laid off after announcing I would be shifting hours due to Prostate cancer/radiation therapy. This was way before RTO policy. Just trained my 5 Indian replacements.
They don't care.
Stage 4 Warrior here. They can and will lay you off even if you are on LO A getting treatment.
Your status on leave, STD or LTD can't be considered as criteria for displacement - either to protect you or target you.
you can be notified of displacement while on leave, but the actual process doesn't trigger until you return from leave.
So if the question is: can I find out I don't have a job to go back to while on STD or LTD the anwser is "yes"
If the question is: does my approved LTD or STD get cut off at notification and I enter my 60 or 90 day notice period, the answer is "no"
Once you get to long term loa you are safer
I was laid off last year while on leave for cancer treatment …I agree with above post about getting it on media as we know WF can’t afford any more negative press.
If I were you I would get a lawyer if they lay you off while on medical leave
Yes, you can be laid off during medical leave. I know someone that had this happen to them. Either short-term or long-term. They can’t lay you off because of the medical leave, but can displace you for other reasons (e.g., staff reductions) during medical leave.
Yes you can still be laid off but your severance would not kick-in until your the end of your STD runs out.
What's especially Fd up about the company laying people off on LOA is that at that time they aren't even paying the employee, the insurance company is. That's some evil S right there.

If you and everyone else at your site are let go, you're gone. If you were the only one let go while on medical leave, then that would be an issue. You aren't going to be spared just because you're on medical leave.
You can & will be laid off while on leave.

What kind of sh---y company lays off an employee battling cancer? What in the actual fu-k is wrong with this place? Someone needs to take that story to the media. Fu--ing outrageous.

Wells Fargo has laid off people on medical LOA, unfortunately. I know 2 people personally. One was out for knee replacement surgery. The other was an excellent manager recovering from intestinal surgery related to a serious condition. Having said that, I would definitely call HR and if they say you are safe - have them send that to you in writing.
I’m sorry to hear about your health. You shouldn’t have to worry about losing your job when going through an illness. Best of luck to you.
