Anyone else seeing this at their workplace?

You are protected under the law and you can sue your employer while still working there.

• Verbal abuse: Derogatory comments, jokes, or insults about age, such as calling someone “too old” or implying they’re less capable.
• Exclusion: Denying older employees opportunities for promotions, training, or key projects due to age-based stereotypes.
• Hostile work environment: Creating or allowing a workplace where older employees feel demeaned or marginalized, like pressuring them to retire.
• Unfair treatment: Disciplining or scrutinizing older workers more harshly than younger colleagues for similar issues.
• Retaliation: Punishing older employees for raising concerns about age discrimination.

@qk Again, where’s the proof?

I keep seeing these anecdotes, but nobody ever shares dates, times, locations, or anything that would substantiate their claims. If you’re in Texas, you’re within your rights to record workplace conversations without saying so to the other parties. Curiously enough, none of you seem to be doing this, probably because you’re all saying things daily during the very same conversations that would get you fired immediately.

Also, did you report this to HR and give the company an opportunity to resolve the issue? Didn’t think so. BTW, one dou--ebag isn’t a strong indicator of institutional discrimination being systematically directed towards an entire class of people. The company can easily cover themselves by firing the dou--e then let you go a month later for pretty much any reason (or no reason).

If you want to sue them, sue them. Let us know how it works out for you.

Older employee disrespect is rampant and accepted. The only thing they care about is following their NSI to PIP plan. I've been blatant told to my face by my supervisor that I'm "old and irrelevant", among other things. No recourse, nowhere to go with it.

@em because the age discrimination laws have no teeth and the burden of proof for an individual employee is too high. The company and its management minions know this. The entire performance ranking system is crafted to protect the company from legal action while allowing them to systematically reduce headcount under the thin veil of “poor performance”. And you’ll never find a management whistleblower because they know anonymity is a joke, and they love their fat salaries too much to take the risk.

The discrimination cases I've looked at all resulted in the firmer employee getting hammered flat. The company lawyers are better than yours and the managers are well coached for depositions and will make your attorney cry.

If not, it didn’t happen (even if it did).

Court isn’t about what you know. It’s about what you can prove.

Get it into your heads that you’re not going to win some blockbuster case against EM at the Supreme Court. The EEOC at the DoL investigates discrimination claims all the time, only to find that they have no basis and the person making the claim has zero proof.

My advice: do as much of your communication in writing as possible, especially if you think someone has it out for you.

There was once a young arrogant a hole tech. He went around saying he was the best and the old folks weren't s hit. He constantly said the old needed to go and make way for the young. He personally torpedoed several older workers. He said they were sleeping on the job and too slow. He had a safety incident and almost got fired. He was told to slow down and think things through. He is now more humble and quiet. He is still a piece of s heet though and always will be. The young one was placed in charge of projects the oldies were more experienced in. When the oldies asked why they were told the young one needed exposure.

@a9 You’re most likely in Texas. Most of the whining about age discrimination emanates from good ol’ boys sitting in EMHC. A quick scan of the threads here confirms this.

If you want to sue them, then sue them. Just don’t expect to gain anything except high legal bills.

FYI ….Exxon gets sued and loses all the time. They are not above the law. You really think a jury is going to be sympathetic to Exxon.

Proving any of this court is nowhere near as easy as many of you seem to think. There is an extremely high bar to proving any form of discrimination in any court.

The company also has more than enough money to bankrupt you by burying you in procedure, and they can foot-drag for months before anything even makes it to court.

Keep in mind that Texas oil companies have basically picked most of the judges in both Texas State courts and the federal courts within state bounds. You can mostly thank yourselves for that bit.

If you’re at the point where you think you’re being discriminated against because of your age, it’s probably time to retire anyway. Just move on for goodness sake.
