@1qm the 33% applies to the 50 or more trigger. The 500 is a different trigger. Warn is triggered for Houston unless layoffs are <500.

Seems like a potential issue with TWC receiving it.

@1qm I think SP1 and SP2 would each be separated in having >500 since they each have their own address.

TWC said they haven’t received a WARN notice from ConocoPhillips since 2020 (I emailed and asked). In the email we received for COP, it said “in the event” this triggers the WARN act. By that logic, you can expect numbers at Texas sites to be <500 and <33%. For Houston, 500 is shy of 20%, so may be less impacted than other sites which would make sense with the centralization model.

Check here on October 1. Looks like this sheet gets updated the last business day of every month. It'll be interesting if our notice is there when it hasn't shown up on the other official source yet.

@wj the question really should be "why hasn't TWC posted it" vs "why hasn't COP issued it." COP literally reached out to Reuters to get the news out there the way they wanted it the day before issuing the notice. And ya'll wanna act like COP's intentionally violating requirements. I promised you they aren't .

@np so just because TWC hasn't posted the notice doesn't mean state agencies haven't been notified.

I bet if you requested the notice from TWC, which you can do, they'd be able to send it to you.

The WARN act requires that state agencies be notified. There is no entry for ConocoPhillips on the Texas Workforce Commission site. This is in addition to notifying workers.

When numbers are posted please add one to the number. This is for the guy who said the need for the lay-off was all his fault. Ok, so honesty is a fine quality but when you make millions and sc--w up you should be fired.

@ge workday severance pay education guidez example severance timeline illustrates a 21 day notice period (remain an active employee) with final payment the following week, week 4. FAQ for the WARN notice email #5 says employment end date = last an employee is on payroll, and per the notice that is Dec. 1 (week 4) Tie these together, FAQ #6 indicates ONLY "some" employees will be asked to work some or all of the notice period.

What are you seeing that's different?

@je see prior comment regarding triggers. Regarding the L48 = Houston comment, if that were the case those L48 employees would have gotten the notice emailed to them.

Certain situations trigger the WARN Act in Texas:

  1. Plant closings affecting 50 or more employees for at least 30 days.
  2. Mass layoffs involving at least 500 full-time employees.
  3. Mass layoffs involving at least 50 full-time employees, constituting 33% or more of the employer’s workforce.
  4. Plant closings or layoffs extended over 90 days.

@e4 I don't know. I highly doubt Midland won't have at least 50 laid off. Possible? Sure. But seems unlikely so there should be a warn there.

That said, I heard company legal is advising since all L48 reports to Olds and he is based in Houston, all L48 are therefore Houston employees and don't need a separate warn. If this is how they're going to try to do things, I see a lawsuit in their future. Surely they aren't that foolish.

@gt Great last point. I always have concern that at the level decisions are being made, they most likely don't know much about the worker bees, their work ethics or capabilities. I just pray for a fair shake and decision making based on my integrity.

This is all such a horrible thing to be going through due to no fault of your own. Hang in there and don’t try to act like you’re not stressed out. Don’t keep it inside. If you do make it through and keep your Jo consider yourself lucky but not better than those who got let go.

@fv layoffs will happen the week of Nov 10. Dec 1 is just your final payment date. Your last day is Nov. 10 or whatever. You'll get a paycheck by 12/1 with the 4 weeks minimum severance + accrued vacation. Employment end date just means you're off the payroll. The term is described somewhere. You don't get paid for Nov 11-30 work days.

@ft I was referring to the fact the email also said “end dates of December 1st” notifications can be Nov 10. meaning if you consider 12/1 the severe date ie date of final pay, the 60 days hasn’t started yet - that’s an explanation for why a number hasn’t shown up on the website

The WARN notice emailed to employees said "as early as Nov 10." Yes, they can walk you out sooner and pay you until then. Just not sure what your intent is given the context of the conversation in the thread.

@e1 Thanks for the information and that makes sense. I did just want to add that my org, which covers multiple locations, has been told this is not happening in waves. I think other locations just didn't meet the threshold for a notice to be required.

Since they sent the warn email to Houston employees, that counts as a notice. It doesn't have to be official through the state to meet the layoff date target. This basically just means Houston will be the first wave. Other locations will get their own notices and then their 60 day clock starts.

Looking back at the WARN notice filed in Nov 2020, there wasn't official employee reduction count, so I dont think that would be a reason for not having the filing listed on TWC now given that notice was filed. Strange. . . .

@bj so you're saying Ryan addressed why the WARN notice would be posted to TWC's site late? The townhall happened the morning of the day the notice was emailed to employees. If he did address that it would be posted weeks after filed, please do enlighten us.

Could it be because they don't have an exact number to report? I have no idea. I just noticed all the 2025 listings on TWC's website have an exact number, with the exception of 1 company.
