If you work in a final pay state you were paid. Those of us not in a final pay state got the email from LM.

May want to review the information and possibly file a claim for unpaid wages with NJ DOL. BBB meets the criteria to pay liquidated damages up to 200% of the unpaid wages but not to exceed $50,000 total.
My thoughts are to get on the books with the state prior to bankruptcy declaration. If BBB declares bankruptcy and no claim is filed then definitely will be paid only the unpaid wages which is severance pay. Normally, secured debtors are paid first then employees with outstanding wages due. Just my thoughts but should conduct research as well.

Strange, why does their message indicate Wednesday, February 8? The conspiracy theorist in me would suspect they're making some announcement prior to that date.

The email went out to everyone that their severance payment has been delayed. Whether you were recently layed off or were layed off prior. They didn't have enough money to cover payroll and this was they way that they could come up with money to cover pay for those that are working.

If they were declaring bankruptcy and not paying, it would be across all employees. Most others are getting their pay. I think they're making changes that's causing this.

I received it to regarding severance that is due. They seem to be prolonging payment so that when they declare bankruptcy they don't have to pay it and we all get added to the list of debtors. Don't be surprised if some big announcement happens tomorrow.
