Thread regarding Optum layoffs

WARN Notification

Has anyone taken a look at the WARN notification in your state? If they layoff a certain number of people all at once, then they have to give WARN notice. I don't see Optum listed.

New Jersey WARN Severance Pay Challenge Rejected

On April 6, 2023, a New Jersey federal court denied a request to invalidate the severance pay requirements of the amended New Jersey mini-WARN law, known officially as the Millville Dallas Airmotive Plant Job Loss Notification Act (NJWARN). Accordingly, the law’s new severance pay requirements will take effect on April 10, 2023, along with all other provisions of the amended NJWARN law. Of note, the court did not reach the merits of the argument that the severance pay requirements were invalid and preempted by the Employee Retirement Income Security Act (ERISA), but rather held that the industry group that brought the legal challenge lacked standing to raise the argument. As such, the issue remains unresolved and subject to another legal challenge in the future.

The amendments to the New Jersey WARN Act (NJ WARN Act) will take effect on April 10, 2023, after a nearly three-year reprieve due to the COVID-19 pandemic. On January 10, Governor Phil Murphy signed Assembly Bill 4768, which sets the effective date of the amendments to 90 days from the date Assembly Bill 4768 was signed into law. While the amendments were originally enacted in January 2020, due to the COVID-19 pandemic, Governor Murphy previously signed legislation delaying the effective date of the amendments until 90 days after the state of emergency declared by Executive Order 103 of 2020 had been lifted. Assembly Bill 4768 unties the effective date from the state of emergency declaration.
