50+ layoffs triggers WARN notice in New Jersey

NJ now has an amended law that went active on April 10 where any company with 100 or more people laying off at least 50 people have to give 90 day notice to those who are getting laid-off and they will be listed on the NJ WARN notice.
But I bet you most companies will cut 49 people just to not trigger the law.

Verizon usually gives the laid-off 60 days before going off-book, so they can have surprise layoffs without running afoul of the WARN rules.

https://www.dol.gov/sites/dolgov/files/ETA/Layoff/pdfs/WorkerWARN2003.pdf

"You must receive a written notice 60 days before the date of a mass layoff or plant closing if you meet the conditions discussed in this brochure. If your employer does not give you the required notice, you may be able to seek damages for back pay and benefits for up to 60 days, depending on how many days’ notice you actually received."

That is almost the same as the Federal requirements except at the Fed level only 60 days notice is required. The 100 employees and the 50 employee layoff counts are the same and have been for years.
