Can they lay you off while on medical leave? Having surgery this week want to make sure I’m not putting myself at more risk

Yes, a company can lay off employees even when on FMLA. It is not illegal for an employer to lay employee off during FMLA leave, but it is illegal for an employer to lay one off because of FMLA leave.

They absolutely can lay you off. I have seen someone get laid off during Sabbatical.

Yeah I heard last round (maybe the time before) that they let someone go while on PTO. I think the only way they can get away with this, is they "say" they are notifying you 60 days before your term date. Otherwise I would think FMLA (Famly/Medical Leave Act) would kick in, its supposed to protect you from loosing your job due to any Family or Medical leave you take. But I am not a lawyer either, I am sure CS has better lawyers than me. :)

Yes, they can definitely lay you off during medical leave . Also while you are on sabbatical.
