VMware Severance clarification

There is a lot of confusion about this so lets clarify it once and for all. Here are the facts that I understand, please clarify if something here is NOT true.

  1. Broadcom has to follow VMware severance policies for 12 months after the merger per the merger agreement.
  1. VMware severance policy as it stands now is to provide:
  1. 2 months of notice where you will be on payroll and at the end of that period 2 months of severance as a base plus 1 week/year of continuous service subject to a maximum.

OR

  1. If you are NOT provided a notice period and laid off with immediate effect then 4 months of severance plus 1 week/year of continuous service subject to a maximum

There is also a provision to provide 3 months of COBRA premiums.

I got the above interpretation directly from text in the official "voluntary separation agreement". If the above understanding is incorrect then feel free to clarify.

Sounds like a 4-month lump sum if you work the notice period.

Here's what I see on Source today:

Each eligible employee is eligible to receive the base amount of severance pay. The base amount of the severance pay for eligible employees varies depending upon the level of the employee and whether the employee’s Severance Agreement states that the employee is required to work the entirety of the Notice Period.

Below Vice President / Below Principal Engineer Level: Each eligible employee in a job grade of
20 or below is eligible to receive a lump sum severance payment equal to:
 two (2) months of base salary, if he or she is not required to work for the entirety of the
Notice Period; or
 four (4) months of base salary, if he or she is required to work for the entirety of the
Notice Period.
Vice President and Above / Principal Engineer and Above: Each eligible employee at or above
the job grade of Principal Engineer (job grade ≥ 21), or Vice President (job grade ≥ 22) is eligible to
receive a lump sum severance payment equal to:

 four (4) months of base salary, if he or she is not required to work for the entirety of the
Notice Period; OR
 six (6) months of base salary, if he or she is required to work for the entirety of the
Notice Period.

From what I can tell, there's either 2 months + 1 week/year of service or 4 months severance including working 60 days notice if they need you. Your text seems to imply that if they don't want you to work out the 60, they give you 4 months anyway.

On that point... They will need to follow the AGREED severance policy for 12 months as part of the merger. Every country is different when it comes to minimum statutory payments along with notice periods which may not be applicable if it's in your employment contract you have agreed to something different.

Aside from the statutory minimum payment anything else is ex gratia and can change. I have seen severance packages vary alot over the last number of years in VMware from really good to not so good. Team members within same dept / BH in different countries will also get different packages, again based on local minimum requirements.

It is not correct. If a person is laid off without getting an extension for 2 months of work, then that person only gets 2 months of severance and then 1 week per 1 full year of service.

Assuming the layoff notice comes on August 31st for both employee A and B and both are below VP level.

Employee A is asked to work two months for transitional purposes, then he/she will work until October 31 and get regular paid for those two months of work. After that, the person will no longer has company access and will be considered terminated on November 1st. The person will get 2 months of severance pay plus 1 week per 1 full year of service. CORBA starts on November 1st for this person for 3 months.

Employee B is NOT asked to work for two more months, then that person will be terminated and no longer has access starting September 1st. The person will get 2 months of severance pay plus 1 week per 1 full year of service. CORBA starts on September 1st for this person for 3 months.

This is perfectly correct, confirming based on a guy who got layedoff on 24th july.

Subject to max is , its maxed out at 12 years 12 weeks.

Am I not understanding this correctly? I read it as if they don't give you a notice perod they just give you a two months severance.

But NOT prorated. So if you have 11 months in and they sack you, they round down.
