Citi “No compete” vs moving oh so on

No compete is for vendors we do business with, not the competition. We work with and have a no compete with company ABC. You can’t leave Citi and go to work for company ABC for 1 year. If let go by Citi, the no compete is null and void.
The no compete does NOT pertain to the competition. There are employees who leave Citi to go to work for other banks all the time.

Yes, if you leave Citi you are contractually bound to NOT poach from Citi.
IF, however, you were to lookup where you colleague now worked at and applied for a job on your own without the solicitation, there is nothing that Citi can do about it. This is done all the time and has nothing to do with no compete.

An easy LinkedIn search to see where your colleague went to work is easy to do. Followed up with a LinkedIn Job search for that same company, this too is done all the time.

Its important that you know the no compete has been challenged in the court system. It was determined that a company CAN NOT keep you from getting a job if they let you go even if big mega corp has a no compete with 200 vendors.

Citi is a huge company and works with a lot of vendors for which I’m sure they have a no compete with as many vendors as possible. Its part of Citi’s fear strategy. They know they are NOT going to pay you market value and leverage the no compete to try to keep you from going elsewhere. ITS ALL NULL though if they lay you off.

If I get the boot I will get an attorney before signing anything. And yes, they can’t enforce you working at another bank. That said, if you “steal” a bunch of clients or take proprietary information that’s different issue.

A no compete to keep you shackled, ok, I get it. A “you’re laid off, by the way you still can’t work at this companies even though you are jobless”, while I would not put it past Citi to be that cold, it can’t be legal can it? that’s messed up.

Legal consulting would be best, that is true. It’ll vary from state to state. Yes, if layed off, if the non compete is excessive and abusive and violates the guaranteed freedom of work and guaranteed right to free development of economic or professional activity, then it can be challenged in court.

If you are a programmer and Citi has a no compete with all the major vendors and partners in a city who also employ programmers, and they let you go, they can’t keep you from employment elsewhere such as from those vendors and expect you to just starve.

The no compete for Citi is 1 year as I understand it. A lawyer can best determine the merit of the case. Where companies often make a mistake is in trying to convince you that you have no options and absolutely no legal recourse at all so don’t even try.

Yes a no compete is effective but it can’t take precedence as a blanket condition. Going back to the programmer “you can not get a job programming at all for any company on this list” and that list is composed of all the other companies that hire programmers, that’s excessive and I can’t see that holding up in court. Again, legal consultation would be warranted.

If you try to leave on your own to a competitor or not, for good measure, just ask.
Ask if they have a no compete with Citi, it can save you the hassle of the whole interview process.

If Citi lets you go, then it should not be an issue either way.

If Citi tries to strong arm you and manipulate you, challenge it. If Citi lets you go and tries to keep you from getting a job with another company that they have a no compete with, challenge it.

Keep in mind that there are a ton of lawyers out there who are more than willing to make a name for themselves in a David vs Goliath court battle. Many have no issue taking it to court on contingency meaning that you don’t get charged for legal fees unless they win in court, assuming you have a strong enough case. You have the 100% right to sue Citi for any wrong doing. Lawsuits can encompass punitive+mental anguish and stress+legal fees+loss of wages.
