Are we “allowed” to start a new job before we get severance?

I was laid off in February and having a hard time understanding the offboarding paperwork. I’ve been applying to jobs but I do want to collect my severance in May. If I get a job offer before then, does Nike expect me to forgo the severance?

Anyone else have a better grasp of the legalese?

@5shg+1rJRLLab that's fair enough, and I guess I shouldn't judge what works for them. Not everyone can speak clearly about their previous roles, knowledge, and experiences without the help of AI. As I mentioned, I've been thanked after interviews for my genuineness and offered roles at Fortune 50 companies without the need for any of that. If you're as charming as a brick, then ChatGPT is for you, I suppose.

Upvotes don't mean anything other than there are a lot of people here in the same boat - unable to clearly articulate the value they would bring to an organization. It would be frustrating to work alongside someone that can't put together a coherent thought without the help of a chat bot.

@5lxd+1rJRLLab Not gonna speak for the poster you’re responding to, and I think the upvotes speak for themselves.

But that person already got a job offer and was replying to another person asking for tips. Obviously ChatGPT can’t interview for you so hiring teams clearly liked that person.

The person even said they re-word the ChatGPT outputs, which are already based on their own past resumes. At the end of the day, it’s not that different from using google

Yes I believe that once you are past your termination date, you are free to get a new job. If you’re worried though you can always keep it on the DL and not update LinkedIn.

Lol if you need ChatGPT to prep your resume and interview talking points...I don't even know what to say to this. No wonder companies are screening even harder these days.

And it's also no wonder that the feedback I've received from the last few interviews I've done with other companies is "they really like you as a person and want to make you an offer.". Maybe try being an actual, fully formed human being.

So hypothetically, if my Nike termination date is May 1 and I receive my severance at that time, I can technically start a new job on May 2?

I’ve researched this heavily and spoke to a lawyer. It’s a slippery slope if you are still employed by the company until X date, then get your severance payout. Taking a job before your termination date may technically put you in violation of your agreement with Nike to be solely employed by them. On the flip side(assuming they waived your NCA) would a big company like Nike who wants to maintain an image of treated people right really pursue that action against someone they let go who was lucky enough to find a job quickly.

@ypm+1rJRLLab I just want to flag the same happened to me about not getting my paperwork, it took me forever to get a response and I had to email our Vp and ask about it… actually it’s sent by an Adobe esign email and often goes to spam so don’t look for a people solutions email for the document. I thought it was a month late but I just missed the email.

Search your email for “severance” or “adobe” and see if it you see anything

I’ll use a similar approach by talking in hypotheticals.

I’m certainly grateful to be navigating an offer so soon, and I hope I can help others reach offer stages in such a difficult market.

Obviously different industries and role types face different challenges right now, but here are some general tips that have led me to success in my job search.

(Sorry in advance for the long response, but I hope it can help you and any others looking for jobs!)

  • Focusing on quality over quantity of applications (only going after jobs that I’d like for which I meet all requirements). I could usually do 2 top notch applications in 6-8 hours with occasional breaks.
  • Using ChatGPT 4 to help tailor resume sections to job descriptions
    — I use a prompt to tell GPT to assume it’s a world-class resume writer and career coach, and that I’m looking for help tailoring a resume to a job description.
    — Paste the job description into the GPT prompt (GPT asks for it if you’ve told it to behave as a career coach)
    — Paste 2-4 other recent resumes that most closely match the job description
    — Asking GPT to focus on one section/experience entry at a time
    — Reminding GPT to balance bullet point text using the same words and themes of the job description while showcasing measurable results/impacts of my past roles
    — Fine-tuning the outputs from GPT, both by asking it to “try again” and by rewording myself (always a least make small changes so it doesn’t seem like GPT wrote the whole thing)
    — Pasting the final draft of the now-tailored resume back into GPT to ask for any other feedback, edits, etc. before next step ->
  • Using Jobscan.co to “grade” my resume (and cover letter when including one) against the job description
    — Jobscan asks you to input the job description and your resume for the role
    — it then gives you a score out of 100 that represents how the employer’s ATS would grade your application against the job description
    — Jobscan then provides tips and wording choices to increase the match % against the job description
    — Make changes based on Jobscan score & suggestions, re-upload the new resume to get a new score, then repeating the process until getting a score of 80+
    — Follow the same process for a cover letter when including one (they also help increase your match score)
    — When I submit an application that Jobscan scores as 90% or higher, I always at least hear back from the company (even if they tell me they’re not selecting me for interviews but hope I apply to other roles)
  • When I’m selected for an interview, I start prepping as if for a final exam
    — ChatGPT is also great for suggesting what to focus on during interviews.
    — GPT saves different chats, so I have a chat for every application it’s helped me write
    — I use the same chat that helped me generate a resume, and then say something like “now I need to prepare for the interview with this company. What should I focus on? What kinds of questions should I prep for?”
    — If the recruiter gives any details about the interview beforehand, give that info to GPT
    — I use word docs to frame up my responses and real-world examples for the questions I anticipate
    — When a question comes in that I’ve prepped for, I pause for a few seconds while looking for that part of my prep doc, and then I speak naturally based on my notes - I never read from a script

There are countless YouTube videos, Reddit threads, LinkedIn articles, etc. that cover general application / interview tips, plus some that focus specifically on how to use GPT 4, Jobscan, and other tech to help you land and ace interviews.

There’s an email address set up specifically to confirm if your noncompete will be enforced or not. Ask people solutions for it and get confirmation in writing.

If you haven’t signed your severance agreement you should do that before taking a new role. Ask for the agreement to be sent asap. Some people have them already and some don’t yet.

It’s mind blowing how poorly the offboarding is happening. Over a month since round one and most people I know haven’t received anything to sign yet. Perhaps because of the age discrimination suit, not sure.

@smk+1rJRLLab I used hypotheticals and asked “may I start another role before severance ends? And will this impact my severance?”

Until I got my waiver of NCA I didn’t speak specifics on companies. Congrats on getting an offer so quickly in this market! Any tips?

@pzb+1rJRLLab How did you approach People Solutions with the request? Im in a similar boat and actually negotiating an offer right now. I plan to contact an employment lawyer, but it’d be even better to get something in writing from PS.

When you reached out, did you speak in hypotheticals or did you ask about a specific company, industry, etc.?

I’d love to follow any advice you can give, especially since People Solutions has already “approved” a request similar to what I’d ask.

Ask people solutions and get it in writing. They told me it’s ok, but the non complete wasn’t waived yet so was also limiting. Definitely recommend getting it in writing from them vs here though!

You no longer work for them unless you signed a non compete or something else in your agreement that says you’re not allowed to work due “trade secrets” ~usually tries to limit you from a design role so you don’t take out precious designs with you, your good . Like how would they even know.
