Yes I got laid off, I got severance and it has run out. However, a line in the separation agreement stated, "agree that you will not apply for or seek future employment with the Company or any other Company Releasee." I saw others in the past at BNY who were laid and came back after their severances ran out. What does it mean, do I get penalized if I try to apply on my own or does a manager get penalized if they do accept me?

That may be all they really care about. If you see them all cashing out soon and bailing, you'll know. (He-l, if I could sell my 6 shares now, I would!)

ID- @3hsa+1uEiwHm7 - just for reference- Enron, Merrill, Boeing, and most recently SMCI all had stock prices that were flying.. until they weren't. Obviously u likely have not talked to anyone in the org... which is not a bad idea to understand the situation in the room. Not a single person top to down would have a positive recommendation on this one. But ... to each his own !
Apply and find out. Taking advice from the group on this site is as crazy as going back to BNY.

If their measure of success is getting the stock price up - even in the short term, they've succeeded. Is the goal to "build a better company", or to increase the value of their stock options?
I've known BNY programmers that have been laid off and came back as contractors. They named their price and BNY paid up because they were behind on so many client commitments.

Come on, this is the reason the managers keep abusing on employees when they come back. Find your ego and look for a new job somewhere else. If the whole industry workforce keep changing jobs, the management won't abuse the worker as bad.
We had a guy in our office that was just laid off for the third time. Seriously, I’m not kidding. 3 different roles 3 different times laid off!
Not sure why that was part of your agreement. I know many people who have been laid off here and have come back. I never even knew that could be an issue, unless you were terminated for cause or something along those lines.
You can’t come back based on what you mentioned was included in your separation agreement. When you resign or laid off a note is entered on whether you are eligible/ineligible for rehire. HR wouldn’t allow you to be hired based on what you mentioned

First of all, you have to swallow your pride. I have seen a few came back. I have not seen any mgr getting penalized hiring someone back. Good luck
Who ‘got laid’ at BNY and came back? That would imply something pleasurable. LOL… this place is more like the Mountain men scene from ‘Deliverance’.
