Thread regarding Cisco Systems Inc. layoffs

severance?

Is there any situation where an employee could be denied a severance package during the September 16th layoffs for an unfair reason and just let go? I don’t trust my management, and while I know it might be uncommon, has anything like this happened before? I’m okay with leaving as long as I get the severance, but if not, I need to be prepared with a backup plan and possibly a lawyer. Any advice on how to handle this kind of situation? This is a genuine concern, not a joke.

It's easier all round to just give you the money and move on. After all, the money is coming from a central bucket, no skin off the manager's nose.

Does anyone know if they pay out new employees even if they are not technically eligible under local laws though?

Also to add to my comment below, local law example:

In Australia, to be eligible under Fair Work to be eligible for a redundancy payout, you can NOT be any of the following:

  1. Employed for less than 12 months (continuously)
  2. Hired on a contractual basis (specific project, seasonal work, fixed term contract etc)
  3. Have serious misconduct allegations against you
  4. Be a casual employee, trainee or apprentice.

If you don't fall into any of those spots, you would be eligible for a redundancy payout under Australian law.

So.... depends on where you are from.

Depends on local laws and your contract.
For example - some countries have a probation period, like in Australia, that during that period (defined in your contract, but it can be anywhere from 3months to 6months) they can let you go with no notice if you are not a suitable fit.
If your local laws protect you from unjustified termination and set redundancy minimum payout, Cisco would need to have a rock solid case, that wouldn't be able to be contested in court, otherwise they won't bother and you would likely be safe and would get your payout.
