And you have a family to support..and you are fearing a layoff, go get a disability note started with your doctor and you'll be safe. They can't do layoff if you are disabled and if they do, then you can give interviews on CNN, Fox News and everywhere and charge two times your annual salary.

Man.... Would'nt it just be easiEr (more productive anD ethical) to spend all this time in prepping for a job instead... You will need a job at some point anyway... Why not start now... ? More healthier approach to this layoff thing IMO.

You have no idea what you are talking about. Even pregnancy and fmla leave do not protect you if they are doing a large scale layoff. You still get let go s d it's not against the law because when there is a layoff everyone is treated equally from a "who can be RIF'd" perspective.

Ps stop trying to assume you know about disabilities. You have no idea what people's real health issues are and how they impact them. Look to yourself and stop whining about everyone else.

Talking about short term disability, I've seen a person that worked with me go on a short term disability saying she was very stressed. Believe me, I worked longer hours than her and held more responsibilities in the project. For 3 odd months she was out, she used to party hard, go shopping, do a bunch of activities for herself and her kids. Moreover, I had to take up all the project tasks assigned to her. I'm sure there are many like her. OP, please don't make these silly suggestions are corrupt people that are ethical, but I understand you are saying it to safeguard jobs or delay job losses for those who are the only income in their household.

Unless you have Steve Jobs ba level of caliber or someone who has the guts and balls to challenge life and try things from minimal state.. Work from garage...start your own business...be very resilient (above all), don't bother comparing... The fact that u seem to be "hurt" with this simple basic layoff says zero resilience.....

I have seen short term disability, sexual harassment and general harassment being (mis)used a few times but I remember in all cases the people that used these were very shrewd and cunning. Don't even try if you are not good at lying and making up things.

For those of you who talk about karma - losers. i'd say do what is in best interest for you and based on what bets you can take and what relationships are important. do you think leaders rose up because they were nice, steve jobs was a di** to people around him including his best friend but he is worshiped.

I have a better plan. Take out a big fat life insurance policy to take care of your family. Then ride off into the sunset so we don't have to put up with any more of your stupid comments.

OP: Being disabled is NOT and advantage--and it certainly isn't fun. You live your life with an asterisk next to your name, and wind up working twice as hard to prove to everyone that you are just as good as the rest.

If you are planning on staying in this industry, I would highly recommend not doing this shady thing. It really is a small world and bad rep is not going to get you far in this industry...... People will know and as corny as it sounds, karma will get you..... Let me tell you a story about this wonderful thing called karma... Once upon a time there was a very shady "funny" Dir. He liked to backstab folks by providing incorrect review input on folks that he barely knew or even ones he new (bad backstabbing "friend". He went out of his way to write long bad review feedback to get back at people that did not agree with him. This incorrect feedback affected one hard working well deserved guy's promo unfairly, ...he got to read the Dir review word for word....... Now this dir is looking for a job in some well reputated big shot company and sends his resume to bunch of folks working there (who he barely knows, dumb as a candle wick...). The folks are stumped as they don't know him... So they, some of them, call this same guy (common friend), who they think know this funny guy. Guess who this guy is.....hehehe.... Karma....and there goes the wonderful recommendation of this looser idiotic Dir.... Ain't karma good....

Well let me add something to that you can be terminated but you will have a lawsuit that you can file. Sure I've seen it done. People have been terminated while on FMLA but only once they return.

Being laid off while on family medical leave of absence is illegal. It is called a violation of FMLA. If you're on short-term FMLA you are guaranteed your job but not the same salary when you come back. However if you're on long-term FMLA you are guaranteed the same salary but not necessarily the same job. you cannot be terminated while on FMLA

You CAN be laid off while on disability trust me I know. Also you can not accept a new job while collecting, so this really does not buy you much. You could continue to game the system by telling the doctor you are still stick each month but it would probably be easier to just start a new job. If you are out long enough everyone will know, this city is not that big and it will not help your chances of finding a new job.

yes, it can be done. i personally know a person who is doing this in QC. That person was on disability for a surgery and was supposed to come back last month. They were desperate to come back so that they dont impact the job/promotion/bonus etc but when they heard about the layoff news they got a new medical certificate to extend the disability for two more months. that person is now coming back late November.

it can be done, it is not illegal and qualcomm cannot do anything about it and it is also illegal for them to inform any future employer. it really depends on to what extent do you want to take this. there might be some questioning from HR since they have to approve your disability but they cannot really do anything if you get a good certificate from your doctor.

If you are disabled (stress related even), you are still a person with a disability. See a lawyer immediately after being terminated. By law, QC cannot discuss this with your new employer
