Thread regarding Whole Foods Market Inc. layoffs

Whole Foods, California State Law and Sick Time Off.

Is it true that Whole Foods requires employees to use their PTO to cover sick time off in Califorina? It is state law that requires employers to give 3 days of sick time per year and with the cold and flu season upon us that is not good if it is indeed true.

There are minimums for how much sick time an employer has to provide and whole foods pto accrual is greater than the state sick day accruals. Nothing is getting taken away but it has to do with a lot of states having newer sick time laws in terms of being held accountable for disciplinary reasons. Some businesses just offer straight sick time minimums. So you still get that and then you get extra pto which can be considered vacation days. It basically just separates your pto into 2 categories to make the old system work with new laws

You have to have the pto in order to use sick pto. You can use 24 hours of pto as sick time off but only if you have the pto to use it. No pto, regardless if you still have sick pto means you can't elect to use sick pto for a day you call out. You must be able to cover the time, even if leaving early for illness for it to not count as an absence.

DC requires that X amount of time be required for sick time. I haven't been there in a while. PTO falls under this category and we are Required to use it if we call out. Can't call out sick and NOT use it.

correct me if i'm wrong, i think the employee just needs to select sick time, when requesting it in Workday for the states that have the option. Its completely up to the employee to use this benefit.

Yes. Unless you specifically state that you are using the sick days allowed in CA, it will be taken out of your PTO.
