Thread regarding Humana Inc. layoffs

RE: PTO PAYOUT

YOU EARNED YOUR PTO AND HUMANA SHOULD PAY IT OUT ON TOP OFF SEVERANCE, IF APPLICABLE.

RE: QUITTING. AGAIN, YOU'VE EARNED THAT PTO BENEFIT, AS WAS WRITTEN INTO YOUR HIRING AGREEMENT WHEN YOU SIGNED ON AS A HUMANA EMPLOYEE. YOU SHOULD BE ABLE TO RECEIVE PAYOUT OF YOUR PTO/VACATION

RE: TERMINATION/FIRED: "Unused Vacation. If you have accrued vacation days that you haven't yet used when you quit or are fired, you may be entitled to be paid for that time. About half of the 50 states have laws requiring employers to pay out an employee's unused vacation when the employment relationship ends."

JUST CONTACT HR4U AND ASK TO CONFIRM THE ABOVE TO BE TRUE, SO YOU FEEL WELL INFORMED. ASK THE HR4U REP TO PROVIDE YOU WITH A REFERENCE NUMBER FOR YOUR CALL TO KEEP FOR YOUR PERSONAL RECORDS.

These guys are very aware of the discourse amongst us..., and they are going to probably be quite sure that they do whatever they can do...to wipe their butt's of us cleanly....so as to not catch a lawsuit from a unionized group of us. They probably have one of their slimey attorneys checking in on this site daily

You should get your PTO even if fired. I'm in that exact situation, and the PTO policy in HR4U states you will get your PTO payout if you quit, get terminated, or get laid off for a RIF. It doesn't specify that a termination for cause is an exception. (the referenced section 7.0 speaks to COVID balance increases, not anything about termination for cause.), therefore, even a discharge for cause gets their payout.

"Associates with at least one year of service who resign, whose employment is terminated
other than for a Reduction in Force (e.g., company restructuring, position elimination or
facility closing) or who move to an employment status that is ineligible for PTO will be paid
the lesser of the amount of their annual PTO accrual or their PTO balance. (See
Exceptions, Section 7.0 in this policy.)

Associates whose employment with Humana is terminated due to a Reduction in Force
(e.g., company restructuring, position elimination or facility closing) will receive their full
PTO balance upon termination of employment. (See Talent Redeployment)"

Not sure where the question lies in this post. I am one of the "impacted" employees. They told us in the call and in the ppwk that PTO will be paid out on final employee check (last check before severance begins).

Key word: may....you may be entitled to it....I wonder if the laws for your state apply if you are wah, or if the state is where Humana is based
