MUST READ: Getting Ready IF Severance is offered

https://www.thelayoff.com/t/KdWTPCo

Tips to prepare for electing to take the severance...

  1. Take your time if offered severance DO NOT SIGN anything until you clearly understand it

  2. If you are over 40 years old you are under a protected class http://www.discoverwinningways.com/severence-packages

  3. Update your W2 withholdings to 10+ as the tax on the severance can be as much as 50%

  4. Negotiate financial assets such as pro rating the annual bonus, especially if you contributed your work during this period

  5. Download the latest version of the GIG in your region and carefully review the severance formula

  6. Request a copy of your personal file - sample wording here: http://www.employees-lawyer.com/employee-records-request-sample-form/

  7. Keep track of your PTO, sick days and floating holidays via Workday as these will be paid out within 24 hours when you elect to take the severance - - update your W2 with 10+ witholdings as the tax deductions are huge - also you may want to consider changing your 401k allocation to zero.

  8. Do not ever put in writing that you "quit" as WFM may contest your request when you apply for unemployment benefits

  9. In California if you make over $11k per quarter the max unemployment benefits you will receive is $450.00 per week and, yes you are eligible taking the severance

  10. Carefully draft your severance negotiation request thinking about who the best person to send it to. Keep this in mind as this person has to know you in order to help you. This person will not be anyone in TMS, as it is their job to say "No" and process your separation. Read and keep this article handy: http://dearjane.info/how-to-ask-for-the-severance-package-that-you-deserve/

  11. Give yourself time to grieve as this is no different than a break up or passing of a loved one. You don't need to pay a lawyer as there's tons of advice and help on the web - plus if you have any relatives that are in the legal profession this is the time to lean on them to review your draft letters to truly refine your ask.

  12. Remember that you only get ONE chance to write a gracefully concise letter so please make it count! Good luck!

6 and 10 do not really apply to WFM, WFM will not supply copies of your file as stated in the gig, you can have or make copies of severance paperwork as you are allowed to take those home to read, you can get blanks of forms you have signed or take notes on paper of items in your file with Tms present, unless your state has specific laws allowing access to your file. You are usually allowed a limited amount of scheduled time to do this. You can always try to appeal a severance agreement, but it can nullify the original offer if you do, this type of negotiating is usually advice to higher level officials in a company.
