Constructive dismissal, also known as constructive discharge or constructive termination, is a modified claim of wrongful termination. Wrongful constructive dismissal occurs when, instead of firing the employee, the employer wrongfully makes working conditions so intolerable that the employee is forced to resign.

Constructive dismissal/discharge/termination is one of the circumstances where you may qualify for unemployment when you forced to quit because of intolerable work conditions.

However, you definitely have to go through the steps of getting enough documentation to prove that the work conditions were so bad that any reasonable employee would quit rather than continue to work in those conditions.

You also need to show that you reported to your lead about the conditions (excessive work load, inability to get the work done in a reasonable amount of time, etc) and allow him/her time to correct the situation.

In addition to reporting it to my lead, I would contact HR4U with the concern and EAP for assistance. And keep a record of EVERYTHING to take to the UC office when you quit.

If any readers apply for UC based on a constructive discharge, would you mind letting us know how it went for you?

Thanks.

Making the work requirement extremely difficult, if not impossible. to meet is definitely what is happening at Humana. We are told, as HCM-RNs, to get 10 successful contacts a day. Yet, we don't have enough members on our roster to meet this requirement. We are being set up to fail and get fired.

I think Humana, after laying off the first bunch, is waiting to see how many will leave now out of fear of lay off or rushing out to get the few jobs that are out there.

And, by putting so much pressure on the ones remaining, Humana hopes to reduce the work force even more. Devious. And it used to call itself Humana Cares! Sad.
