Who qualifies for the WARN notice????

Hello,

I was laid off recently in Austin. I am curious who qualifies for the WARN package, because I didn't get that deal. Just wondering why I got screwed, I am sure there is an explanation.

Oracle actually did you a favor if you were not under the WARN notice (inadvertently I'm sure).

You shouldn't have to wait >60 days for your lump payout and you won't have to remain "unemployed" for that period to get your severance lump.

Austin person.

The package was not warn+severance in other geographies, so if you think you got screwed out of 8 weeks of pay and benefits you are wrong. Likely much less than that depending on your tenure. They deduct out the warn from your 4+1/yr in CA. You can do the math yourself.

You can also google what triggers warn and you will see why Austin was not included. The impact was not close to either warn trigger.

@iff they counted van de Graff, so it didn't exceed a certain percentage of the total Burlington site. Basically just a technicality to screw their employees over

Are you laid off from Burlington? No WARN for 300!

I have heard more cuts to come for Burl and x86 will also have more impacts due to restructuring and possibly consolidations with CA or Austin. I am in CA currently left on sparc but looking to get OUT.

It depends on your state. People who were RIF'd in Burlington didn't get the WARN package, either.

I don't know how they got around the WARN in MA to be honest. Lots of people were RIF'd, although maybe perhaps not as many as CA. it was horrible.

I think the total number of layoffs in a single site needs to be greater than 50 to trigger WARN.
