Unemployment and Severance

Just a fair warning to everyone. Look out for yourselves. Document everything. SHC is trying to say I worked a day I didn't work to get out of my getting paid for a week of unemployment. I was management level and didn't clock in and out, so my word against theirs. I hope everyone gets out and soon from this shady company!

I agree with the poster above, don't hold your breath for any severance or benefits. If Sears chooses to offer them that's obviously fine with me but I'm not counting on or expecting them. There is absolutely no law or requirement that says Sears has to offer them or make them available. All they have to due in California is give you your final paycheck with all accrued vacation up to and including day of termination immediately at time of termination and offer COBRA within 30 days. Fortunately I live in California so they have to pay all accrued vacation up to and including day of termination. I spent 13 1/2 years with California hourly labor law.

Don't hold your breath for any severance or benefits. The Sears workers in Canada got screwed. I am job hunting every night and don't think it is worth waiting for any severance. We are all screwed. http://www.cbc.ca/news/canada/toronto/sears-employees-complaints-1.4190110

I know about a year ago i made sure i kept copies of any communication this company that included all pay stubbs. maybe over cautious but atleast this way i have proof i worked there

I was out in January and thankfully had no problem, I received all vacation pay and severance.
