Thread regarding Sears layoffs

If you have a disability can sears schedule you outside of your availability for Black Friday Thursday Friday?

I am curious about this as I have a disability and work limited hours and am part time

What do I ask for

A Reasonable Accomidation?

What would happen if store manager said “ oh I can’t do that”

If there are a max number of hours you can work and still qualify for disability, they cannot schedule you more than those hours.

Resonable accomodations means just that "reasonable". LEts say you have a bad back or bad knees and you work a register, a reasonable accommodation would be to give you a stool to sit on. But they do not have to provide a recliner. Just like having limited hours. As far as limited avaliability goes. Unless you have been off every Thursday and Friday in the past then you will work those days. They may limit the hours you work but those are "black out days" in the retail world.

There is a process for accommodations, it's the same hotline you call if you are on leave. There is some physician documentation required.

Reasonable accommodation is job design that is reasonable to allow you to perform your job. They have done this and it appears to me you have no reason to not show up. just because you don't like the schedule. It appears your not looking the schedule to has nothing to do with your physical condition; s--- it up like everyone else. Be grateful they provided the accommodations need for you to be employed.

They have to give you accommodations by law especially if they knew this when you were hired. I don't think they want the trouble. Just to be on the safe side, speak with Human Resource to clarify this.

Yeah I don't know of a disability that prevents you from working specifically on place Friday. They may shorten your shift though. I assume as long as it falls within your "limited hours" you'll probably be working.

Okay here is an honest answer if you are looking for it as opposed to some of the sarcasm. Speak with your store manager. If you have any specific questions, remember there is the 1-800 number that you can call to ask about anything. I would imagine if you are limited to how many hours you can work in a row, he/she will take account of that and only schedule you for the maximum amount of hours you can work.

You could file an EEO but good luck proving your disability prevents you from working Black Friday

I don't know, but with Sears and Kmart, they make you work Thanksgiving and Black Friday regardless of your availability. Now as far as employees with disabilities, it depends if the store manager accommodates or is willing to accommodate them.
