Severance and unemployment

I was just wondering if those who are laid off by Qualcomm are also eligible for unemployment in addition to severance or no?

I've heard that this is not up to Qualcomm to decide but the state you are in, but I can't find any concrete information on it.

Anybody here knows more about it?

isn't that a racket? H1Bs pay their pay-roll taxes and social security and medicare taxes but are not eligible to use any of the benefits.

Everyone, including volunteers are eligible for unemployment. Not sure about those on H1-B visas though.

Is the HR rep going to defend you in court against the state of california? HR reps only interest is to protect the company, not giving you unemployment advise.

The law, which you must swear to in a recorded phone call with the state when you file your clame:

In California—as in every other state—employees who are temporarily out of work through no fault of their own may qualify to collect unemployment benefits

When you volunteered, you had direct fault in contributing to your u employment. It's quite simple, and fraud if you do try and collect it.

I received unemployment after layoff from another company long time ago and also in 2015 qcom layoff when i was a contractor and my contract was terminated

Yes. Those who are laid off are eligible for both. QUALCOMM does not challenge unemployment. This is a reliable source.
