It’s possible to prove age discrimination

A single employee who can prove that age was a factor in denying promotion, assignment, etc....go read it yourself...who has been discriminated against due to age can be evaluated for EEOC violations. Things like failure to provide reasonable explanation of why such moves were made or promotion or bonuses were denied or moving people to less desirable assignments...without explanation or being named BB and pot shotting employees with an article on retiring retirement the day after a layoff announcement, moving employees with more experience and seniority while keeping younger new employees with less seniority and experience...these are the things EEOC looks at. Also, poor definition of job description. Constructive discharge, retaliation. Poor training, unreasonable demands or assignments. I'm not going to go on. But...the first thing to be asked is not the ratio, it will be the criteria used to pick these forces transitions and if that cannot be explained, they are in serious trouble.

As a six year senior, I do believe it. I have seen the older staff picked on, belittled, constantly being closely monitored and watch the younger staff goof off, take longer breaks or lunches. Yes, they do not like the older staff who have worked to have a higher income due to putting in their time and now this time of year, its worse cause they have to find reason to NOT give raises. I am cringing since I turned 60 waiting for them to wave early retirement again, I do not want it but I cannot take this stress of being so closely monitored for no reason, Looking for anything and everything and finding not much. I went to HR cause if this is happening to me it better be happening to everyone on my team, and it is not.

Excellent points. The RIF ironically ridded the HCM team of the only 2 AA nurses. Great reviews, excellent calls. Then the severance papers you had to sign implies you will not sue for discrimination. I always felt some kind of way about that... The leadership emails were obviously promoting ‘the tax breaks.’ Say what you want, but that said a whole lot, and collaborates all this.

As a senior I do not believe Humana is capable at all of age discrimination , I never saw a hint of it.
