"FYI arbitration just ruled in favor of Rph and a SM on this issue! Major back pay coming there way! Anyone that feels you have unjustly been taken advantage of with hours can call advice and council to set up your meeting! The company encourages you to come forward as to prevent class action! They only ask that you confront your DL first to see if they can correct the problem. Many Rph are coming forward , SM do not care that they work the extra hours so they remain quiet and abused!"

Dl said I am paid to get it done. She does not care how much I do on a daily basis and everyone has to work hard. Said not to believe all this exempt status stuff non of it is true

I was a DM with this company! You need to understand a Dm is easily replaced also! I certainly knew my ast managers were doing all the work in the stores! She is correct there are federal laws that govern exempt status . That is why there are no ast managers . They filed suit and easily won 34 million . The initiating ast manager won 5 million the rest was divided among the asts that joined the class action. We were in Fla. I have since moved on but we received additional training at that time to prevent this from repeating.

You are missing the point! Managers are exempt from Ot ! You are not required to labor at work but manage the business! A company or a DL can not choose to break this federal law! They may not tell you to cashier, unload trucks , stock etc , true, but I promise they can not reasonably denie that they are aware! Not knowing is not an accepted defense in labor law violations! Your DL is required to report to the company anything that could be a violation of law. As an example they certainly Fire a little cashier for not checking ids!

My DL has specifically said multiple times if you have to work 90 hours a week to get something done then you better be there 90 hours a week.

Read federal labor laws on exempt classification vs non exempt status and have your DL do the same. This is why you are being removed fro

My schedule and work brain! No records make it hard to prove. You have been writing your schedule in system for years that make it easy to prove you are misclassified as exempt! Only 20 percent of your time can be for doing labor, that is 9 hours a week or 2 hours a day. Hope this helps. This happened at our company and you can read it on the web J work at #### y###r

It's hard to prove. My DL has always said it's retail. you are paid to do the job. He says he doesn't dictate our hours , if you leave early some weeks it ok , if you have to work extra some weeks it's evens out. He would say if your working way over45 then your not doing something right. If I was to say I worked x number of hours extra for x number of weeks he could say he and cvs never said we had to do it

I can honestly say Ive worked 40 -42

Hours about the same as I have worked 45-50 . So I guess I can say Ive not been taken advantage of me they've paid me without fail for many years . All this as you can tell from managers perspective .
