How many of you guys have been laid off that are over 40 years old? It seems that they are getting rid of the guys that have the old retirement plan and are being replaced by new guys. People are getting laid off due to “workforce reduction” and their positions are immediately being posted to be filled without having the option to move 50 miles.

The “old guys” are the ones typically making the most money. That’s where the co. can show the most cost savings. Use your head don’t lose your head, man!
Geeee, it’s too bad that ridiculous “Teamen UP” nonsense couldn’t save your job? Do you really think being a protected class offers protection in the recent staffing reductions? I’m a le---an, Latina, and worked at UP for a great deal of time and wasn’t offered some type of “deal” to protect myself. Through my years I put up with a lot of toxic behavior and persevered. Stop spreading this lie, no employment attorney is going to tell you what you have reported.
Its clear they were trying to reduce pension liabilites. Because they werent laying off younger less productive employees. I was fired a few years ago in one of thier manufactured workforce reduction crises, i called a employment attorney in town. He and every other atty in town knew the dirty trick up has been up to, but as long as wasnt a minority, wasnt a woman or belong to a protected class or status, you werent going to get any damages.
Touchy subject here, but people walked out with a ton of knowledge doesn’t necessarily mean it was all valuable knowledge or current. I saw about 10 people who’s knowledge was past expiration in my department alone. In some of those cases, it was a good thing. 30 years of knowledge that is no longer viable in today’s technological world is ok by me being lost.
For the NA folks, most walked on 2/12 were 45-55 years old, with 10-30 YOS. Very few in the NA ranks will ever reach the magic 60/30. Those days are gone. The amount of knowledge that was walked out was shocking, and scary. They don’t care.
This company is by seniority not by age
If you were elegible for the 5 years of pension benefit for early retirement, volunteered for it and denied, and the laid off this past round, UP truly did you dirty. That extra 5 years had a huge impact on my bosses retirement take home pay. UP can say they can deny at their discretion but if you volunteered, were denied, and then laid off, in fairness they should make you whole. I would talk to an employment attorney about this very specific situation. You may have a viable legal complaint.
For nonagreement, I’m curious how many old heads were laid off this last round applied for the early retirement buyout in 2017 and didn’t get it then. I know at least 2 people that happened that way.
Plenty of over 50s shown the door and plenty of those with less than 5 years....they won’t sue, because they need the severance....and UP knows it.
As for agreement, a guy once said, “A company should get the unions they deserve.”
Railroad probably won’t hire anyone. They are just posting jobs to look like they are in demand.
They laid off several Special Agents, over 30 Agents. Most had the Harriman Act. Today on the job site two Special Agent openings. Imagine that!!
Here’s a thought....call your union that you pay dues to every month. Make them do their job.
If your agreement place yourself or call the retirement board if you can’t draw feb 7. if your non agreement ask a lawyer.
Seniority is king on the railroad for agreement employees! Regardless of age.
All depends on seniority for agreement. Even though some don't think it should.
Are you referring to agreement or nonagreement employees? You can't say this about Agreement employees, as they were laid off based on seniority.
Most the guys laid off where over 40 it seems that they are going after older employees and everyone under 5 yrs. My guess is they will fire not furlough everyone up to 10yrs.
Not true. I work there and there are a group of us over 50 yrs. old still working.
Half the people laid off from my group were over 50.
