Once you've signed to take the SUB package deal, you have absolutely no recourse legally. If in doubt, talk with a lawyer to review the language in the SUB package BEFORE signing. It will cost you approximately $200 for the lawyer to review and provide general advice.
The decision not to sign will likely be decided by you and the lawyer based on these questions
1.Have you been targeted for layoff by being given a below expectations when you were never rated below in prior years. 2. Can you prove this by having printouts of your prior year performance reviews. 3. Do you have any records, such as emails, showing management giving unfair advantage to their friends? One ex. Manager warning you about arriving late while you see their friend showing up late consistently. If in court, your lawyer can supbeona time records using the time in/out via badge swipes for all employees on a team to show the manager did not apply corrective action or decision making across the board and that expectation was undefined within the team.
