Looking for clarification regarding when severance actually starts

Unclear how (or if) W.A.R.N. affects severance payments/duration. The letter in the packet indicates "... last day as an employee in the payroll system will occur on February 28, 2019(or the 14 day period commencing on that date), but your compensation for wages and benefits will continue through April 9, 2019."

Don't understand the April 9th date and how, or if, it affects severance pay. Had 6 years service, so am entitled to 3 months severance. Still on regular payroll until end of Feb. Does the 3 months severance pay start March 1st and continue through March, April and May? Does pay continue through April 9 and then the 3 month severance start (April, May June)? Or something else? The April 9th date is not clear!!

If I interpret this correctly, does this mean that WARN would only benefit people who were laid off that fall into these two categories:

  1. Those that do not accept the package will get paid until April 9

  2. Those that did not work there long enough to quality for severance that extends to April 9 or beyond?

Also, because if you accept the package and your payments go beyond April 9, WARN does not apply to you.

Can anyone confirm this is correct?

I am in the same situation. netbenefits could not answer and told me that they have been specifically asked not to talk about WARN. Called payroll, same story. I as asked to send my queries to a mailbox. I wonder if this is a game to save on benefits that they need to pay.

So if a person does not sign the Release Agreement, does this mean that they would be covered by W.A.R.N., and essentially get pay/benefits through April 9th (which would cover the 60 days requirement for W.A.R.N.)?

The HR person did tell me that I would get WARN act $ and severance but reading the agreement it looks like you would wave WARN notification by signing the agreement. I asked about it specifically when I met with HR. It was later in the week so I would have thought they would have been clear about it.

When you sign the Severance agreement, you agree to forgo the WARN act. Severance pay starts March 1st.

I have heard three different things:

1) Severance starts on March 1st and continues for the entitled time based on (full) years of service (basically April 9th has no affect on severance)

2) Pay will continue until April 9 and then severance will start and will continue for the entitled time based on years of service

3) Severance starts on March 1 and continues for the entitled time PLUS pay will also still be received until April 9

Wish someone could simply say which is correct. GM Benefits has no information, have left multiple messages for HR with zero response yet, finally was given an email address to send the question to … no response yet. I am aware of several people who all have this same question.

I heard the April 9th and your severance go hands in hand. I think the warn is used if u dont get severance but since u getting one , then u can ignore it. So your severence should start March and end before June. But, please verify with HR
