How is refusing to rebadge to HCL treated?

What if one would refuse the offer to rebadge to HCL? Is that treated as practically quitting your job,or are you in a position to refuse without consequences? I mean, if you’re laid off after refusing, is treated like a standard layoff where you get your severance?

They cant tell you that you voluntarily quit. It's illegal. Write up a notice saying that you don't accept the position and you aren't voluntarily resigning. Tell them you are being terminated effective April 5 with the access to the appropriate state unemployment benefits. This is a dirty shady trick and unless you state that it will be treated as such.

They tried to do this to us at Verizon as well. But their big mistake was offering a voluntary buyout with an enhanced severance at the same time they rebadged 2500 employees to Infosys. The domestic employees who declined, roughly 600, had an uprising, and got that same severance deal when they declined rebadging. If you have other areas that are just RIF'ing with a severance, you may have a case. Just a thought.

We received a letter from Xerox that stated if we didn't rebadge to HCL, employment with Xerox would be terminated April 5 as a voluntary quit.

According to the FAQ from HCL, “In-scope individuals who do not accept the offer will be voluntarily resigning from company”.
